Mother and Son Awarded £7,250 After Illness on TUI Package Holiday

In this case, we acted for Lisa and her son Connor after both became seriously ill while staying at the SplashWorld AQI Venus Beach on an all-inclusive package holiday booked with and claimed against TUI.

A Family Holiday Ruined by Illness

Lisa and Connor travelled to Hammamet expecting a relaxing family break. Sadly, their holiday was cut short after both developed symptoms of gastric illness during their stay at the SplashWorld AQI Venus Beach resort.

Connor began suffering with severe stomach cramps, diarrhoea, fever and fatigue. Soon after, Lisa also became unwell, experiencing sickness, diarrhoea, fever and painful stomach cramps. Their illnesses meant they were unable to enjoy the remainder of their holiday and continued to suffer symptoms even after returning home.

Importantly, neither Lisa nor Connor ate outside the hotel at any point, strongly indicating that the illness originated from food or drink provided as part of their TUI package holiday.

Poor Hygiene Standards at SplashWorld AQI Venus Beach

While staying at the hotel, Lisa observed several issues that raised immediate concerns about hygiene concerns shared by other guests. These included:

  • Glasses and cutlery being washed together in a single bowl of water
  • Poor food handling and sanitation procedures
  • Food left uncovered with flies present

Due to these conditions, Lisa felt compelled to buy plastic cups from the hotel shop to protect her family. Sadly, the lack of proper hygiene precautions had already taken its toll.

Serious Long-Term Impact on Lisa’s Health

After returning to the UK, Lisa’s symptoms persisted. Following medical investigations, Lisa was diagnosed with E. coli, and later went on to develop post-infective IBS, a condition that can cause long-term digestive symptoms and significantly impact daily life.

This ongoing condition was taken into account when assessing the value of her holiday illness claim and the compensation she was awarded.

How We Brought a Holiday Illness Claim Against TUI

When Lisa contacted us, we carefully assessed the circumstances and confirmed she and Connor were entitled to bring a holiday illness claim against TUI, as the organiser of the package holiday.

Working closely with their solicitor, Oliver Linton, we gathered:

  • Medical evidence confirming the illnesses

  • Legal arguments showing a breach of duty under package travel regulations

By demonstrating that contaminated food, drink or poor hygiene standards at the hotel were responsible, we were able to establish liability against TUI.

£7,250 Compensation Successfully Recovered

  • £5,000 awarded to Lisa, reflecting the severity of her illness and post-infective IBS
  • £2,250 awarded to Connor, recognising the distress and illness he suffered
