Do Hotels Have to Compensate You for Bed Bugs? What If They Offer a Refund?

Do Hotels Have to Compensate You for Bed Bugs? What If They Offer a Refund?

A hotel refund can put money back in your pocket without addressing the full effect of bed bug bites. But finding bed bugs does not automatically entitle you to an injury payout. The important questions are what happened, who may be responsible and exactly what any offer is intended to settle.

Do Hotels Have to Compensate You for Bed Bugs?

A hotel may have to provide a remedy or pay compensation where it is legally responsible for what went wrong. There is no fixed payment simply because a guest reports bed bugs, and a refund offer does not by itself establish liability for an injury.

For UK services, the Consumer Rights Act requires reasonable care and skill. Depending on the circumstances, remedies can include putting the service right or reducing the price. Citizens Advice explains the remedies for poor service. An injury claim also requires evidence connecting the injuries to the stay and establishing legal responsibility.

How you booked matters:

  • A UK hotel or holiday park: the accommodation provider’s obligations, what happened and its response need to be considered.
  • A package holiday abroad: the organiser is responsible for the travel services included in the package, even where another business provides them. Tell both the hotel and the organiser or representative about the problem.
  • Accommodation booked separately abroad: the contract, provider and applicable law can differ. A booking platform is not automatically the party responsible for an injury.

The Citizens Advice holiday complaints guide explains why booking arrangements affect your options.

A Room Move, a Refund or a Settlement: What Is the Difference?

Look beyond the amount or the name of the offer. The wording helps you understand what the provider is asking you to accept.

What to Check in a Bed Bug Offer
Offer What to Check
Room Move Does it resolve the problem? Record any disruption, injuries or costs already incurred.
Partial or Full Refund Which nights or services does it cover? Does accepting it settle only the accommodation complaint or wider claims?
Goodwill Payment or Voucher Are there restrictions or conditions? Is acceptance linked to settling the complaint?
“Full and Final” Settlement Which claims are being settled, and against whom? Get advice if the wording is unclear or your symptoms are ongoing.

An injury claim may involve pain and suffering, lasting effects and supported financial losses, such as treatment costs or lost earnings. Those are different considerations from the room price. Any refund or payment already received needs to be disclosed; you cannot recover the same loss twice.

Four Things to Check Before Accepting an Offer

  1. The scope: ask whether it covers the accommodation cost alone or also injuries and other losses.
  2. The conditions: save the complete offer, including attachments, any release you are asked to sign and any deadline for replying.
  3. The impact: keep photographs, complaint records, treatment information and receipts. Note whether symptoms or costs are continuing.
  4. The effect of acceptance: if you do not understand the terms, ask for clarification and advice before agreeing.

If you are still at the hotel, give the provider an opportunity to investigate and offer a suitable solution. Keep a record of what is offered and why it does or does not address the problem. Our guide explains what to do if you find bed bugs in your hotel room.

A Refund Offer Followed by a £4,500 Settlement

In a published HCB case, a guest at Martello Beach Holiday Park was offered a full refund after a bed bug problem during his caravan stay. His experience also involved repeated hospital visits, medication costs and an impact on his confidence and anxiety.

Read the £4,500 holiday park case following a refund offer. The published account does not say the guest accepted that initial refund. This is one client’s outcome, not a typical payout or a promise that another claim will succeed.

Find Out What Your Own Circumstances Mean

You do not need to value an injury claim yourself or gather every document before enquiring. Start with where you stayed, how you booked, what happened and the exact offer you received.

Questions You May Still Have

Can I still claim if I already accepted a refund?

Possibly, but the terms matter. Keep the offer, your reply and any document you signed. A payment covering the room price may have a different effect from a settlement covering all claims. We can review the wording before advising whether anything remains open.

Does moving rooms mean I cannot claim?

A room move may resolve the accommodation problem, but it does not undo injuries or costs already incurred. Record when you moved and whether the problem continued. The solution offered and your response are relevant to assessing the circumstances.

Can I get a refund if I found bed bugs but was not bitten?

You can complain about the accommodation and ask the provider to address the problem. Whether a refund or price reduction is due depends on the booking and what happened. Finding bed bugs without an injury is different from having an injury claim.

Can I get the whole cost of my holiday back?

A full holiday refund is not automatic. The remedy depends on the booking, how much of the holiday was affected and what could be put right. Keep a record of the disruption and any alternative accommodation offered.

What if the hotel offers a voucher instead of money?

Check its value, expiry date, restrictions and whether accepting it settles the complaint or any wider claim. A voucher may be offered as goodwill, but its label alone does not explain the terms. Ask for clarification in writing if they are unclear.
