Our client, aged 7 at the time of the accident, was staying at the Zafiris hotel in Corfu, Greece on a holiday booked with TUI. Our client was walking around the sun loungers near the swimming pool at the hotel when she fell down an open access hatch. A member of staff at the hotel had gone to the pump room below and left the hatch door open without warning anyone. Our client had jumped from a nearby wall expecting to land on the floor next to the sun lounger but instead fell into an open hole leading to a chamber.

Following the accident, her father pulled her out of the hole. She suffered bruising, lacerations and soft tissue injuries to her legs and arms as a result of the fall. She was examined by a hotel doctor, cleaned and sent for x-rays. Fortunately, the x-rays showed that there was nothing broken. Even after the accident, our client continued to watch hotel staff open the access hatch and leave it open without any barriers or another member of staff stood at the stop to ensure nobody could fall down. Our client instructed the Holiday Claims Bureau to make a claim for compensation against TUI.

An accident that should have been avoided

We argued that the hotel staff were at fault for our client’s accident. If they had gone about their work in a safe way, especially considering there are children in the area, then the accident would not have happened. The open hatch should have been guarded by another staff member or secured off so nobody could fall down it.
