Injured while staying in an Airbnb?

Airbnb accommodation ranges from spare rooms and city apartments to cottages, cabins, villas and larger holiday properties with facilities such as balconies, hot tubs, swimming pools and private gyms.

An Airbnb booking can involve several different parties. The host may not own the property, and cleaning, maintenance or guest management may be handled by a co-host, property manager or contractor.

This can make responsibility less straightforward than it would be during a conventional hotel stay. An investigation may need to establish who controlled the accommodation, who was responsible for the hazard and whether reasonable steps should have been taken to protect guests.

Not every problem with an Airbnb stay will support a legal claim. Cancellations, misleading listings, poor service and general cleanliness complaints may instead be dealt with through Airbnb’s complaints or refund process.

A personal injury claim focuses on whether unsafe accommodation, defective facilities or another avoidable failing caused an injury. Associated financial losses may also form part of the claim where they resulted from the incident.

Our specialist solicitors can examine the booking arrangements, investigate who controlled the relevant property or activity and identify the parties that may be responsible.

Common Airbnb accident and injury claims

Incidents can occur in many types of Airbnb accommodation, from city apartments and family homes to holiday cottages, rural cabins and overseas villas.

Common Airbnb claims may involve:

  • Slips, trips and falls
  • Unsafe stairways or balconies
  • Defective furniture or broken beds
  • Hot tub accidents
  • Swimming pool injuries
  • Faulty electrical appliances
  • Burns from hot water, barbecues or fireplaces
  • Bed bug infestations
  • Injuries caused by poor property maintenance

Some incidents result from a single obvious hazard, while others develop because a property has not been properly inspected, cleaned or maintained between guests.

Whether a claim can proceed will depend on what caused the harm, who controlled the property or facility and which law and insurance arrangements apply.

Airbnb complaints and compensation claims are different

Many Airbnb disputes involve cancellations, cleanliness issues, misleading listings or refund requests.

These complaints are separate from a personal injury compensation claim.

Where negligence caused an injury, a legal claim may still be possible even if Airbnb, the host or another party has already offered a refund or goodwill payment. Any associated financial losses may also form part of the claim.

The wording attached to an offer should be checked carefully before it is accepted, particularly where it is described as a full and final settlement.

Unsafe accommodation, furniture and property defects

Airbnb listings include many different types of accommodation, from modern apartments and family homes to older cottages, converted buildings, cabins and villas. Their layouts, fixtures and facilities can therefore vary considerably.

Guests should be able to use the accommodation without being exposed to hazards that ought reasonably to have been identified and addressed.

Claims involving Airbnb accommodation may include:

  • Broken beds or bed frames
  • Unsafe chairs or furniture
  • Loose flooring
  • Damaged stairways
  • Broken handrails
  • Defective balconies or decking
  • Unsafe windows
  • Faulty electrical appliances
  • Defective lighting
  • Broken doors or locks

Depending on the circumstances, these incidents can cause fractures, sprains, burns, head injuries, cuts and other injuries requiring medical attention.

A claim may be supported where a dangerous defect should reasonably have been identified and corrected before the guest arrived.

Hot tub, swimming pool and leisure facility accidents

Some Airbnb properties include hot tubs, swimming pools, games rooms, home gyms, play equipment or outdoor entertainment areas.

Airbnb accident claims may involve:

  • Hot tub slip accidents
  • Burns from hot tubs or heated water
  • Inadequate supervision or safety measures where these were reasonably required
  • Swimming pool accidents
  • Unsafe pool or hot tub steps
  • Defective pool surrounds
  • Unsafe decking
  • Faulty outdoor lighting
  • Defective gym equipment
  • Unsafe play equipment
  • Barbecue accidents
  • Fire pit injuries
  • Missing or inadequate safety information
  • Missing, defective or inadequately maintained safety equipment where required

Depending on the circumstances, the person or organisation responsible for these facilities may be expected to inspect and maintain them, provide appropriate safety information and address hazards that could reasonably place guests at risk.

If a defect, maintenance failure or unsafe condition caused injury, the circumstances should be investigated to establish who controlled and maintained the facility.

Bed bugs, poor cleaning and unsafe accommodation

Not every Airbnb accident claim involves a fall, defective fixture or leisure facility.

Claims may also arise where an infestation, inadequate cleaning or an unsafe room condition causes bites, physical injury, damage to belongings or other identifiable losses.

Airbnb accommodation claims may involve:

  • Bed bug infestations
  • Inadequate cleaning between guests
  • Contaminated or unhygienic bedding
  • Pest infestations
  • Unsanitary bathroom conditions
  • Broken or unsafe room fixtures
  • Damage to clothing, luggage or other belongings

Bed bug claims may arise where an infestation should reasonably have been identified and treated before the next guest arrived.

Poor cleanliness alone will not necessarily support a personal injury claim. There will usually need to be evidence that an avoidable cleaning failure, infestation or unsafe accommodation condition caused bites, injury, damaged belongings or another measurable loss.

Related losses, such as reasonable cleaning, treatment or replacement costs, may also be recoverable where supported by evidence.

Who may be responsible for an Airbnb accident?

Responsibility for an Airbnb accident is not always straightforward because the booking platform, host, property owner and organisations managing the accommodation may be different parties.

The fact that accommodation was booked through Airbnb does not necessarily mean Airbnb itself operated, owned or controlled the property.

Depending on what happened, an investigation may involve:

  • The Airbnb host
  • The property owner or landlord
  • A co-host or property manager
  • A cleaning or maintenance contractor
  • The operator of a shared facility
  • A provider responsible for an Airbnb Experience or Service
  • Another organisation responsible for the relevant property, facility or activity

For incidents in England, Wales or Northern Ireland, occupiers’ liability principles may be relevant. The legal occupier is not necessarily the property owner or Airbnb host; it will usually depend on who had sufficient control of the premises and the hazard involved.

Different legal principles apply in Scotland, while overseas incidents will generally require consideration of the law in the country where the accident occurred.

Claims involving overseas accommodation can be more complex because the applicable law, claim deadline, insurance arrangements and available legal route may depend on the country in which the incident occurred.

Our specialist solicitors can review the booking, location and circumstances to identify the parties and legal issues that require further investigation.

Airbnb stays, Services and Experiences may involve different arrangements

An injury during an Airbnb Experience or Service may involve different responsibilities and insurance arrangements from an accident at booked accommodation.

Airbnb states that Host Liability Insurance may provide eligible accommodation hosts with up to US$1 million in cover where they are found legally responsible for bodily injury or certain property damage. It operates a separate Experiences & Services Liability Insurance programme for eligible Experience and Service hosts. The existence of either programme does not automatically establish legal liability or guarantee that a particular claim will be covered, and all insurance remains subject to the applicable terms, conditions and exclusions.

What evidence may support an Airbnb accident claim?

Evidence can play an important role in establishing how the incident occurred, who may have been responsible and the impact the injury had on your holiday or wider life.

Helpful evidence may include:

  • Photographs of the property or hazard
  • Photographs of injuries, bites or visible damage
  • Medical records or hospital paperwork
  • Booking confirmations
  • Screenshots of the Airbnb listing
  • Messages exchanged through the Airbnb platform
  • Host contact details
  • Accident reports where available
  • Witness details
  • Receipts for treatment or additional expenses
  • Evidence of lost earnings
  • Photographs of any safety equipment, warning notices or instructions
  • Screenshots of any earlier guest reviews that appear to mention the same hazard or defect
  • Copies of reports made to Airbnb, the host or emergency services
  • Records showing disrupted travel or cancelled arrangements

Where possible, report the incident promptly to the host and Airbnb through the platform so that there is a dated written record. Retain the original photograph and video files rather than relying only on screenshots or compressed copies. Seek emergency help first where required, and keep copies of all messages and reports.

Save the listing as it appeared when you booked, including photographs, descriptions of facilities, safety information and any statements made by the host. Listings may later be updated or removed, so retaining the version you relied upon can be particularly useful.

You do not need every piece of evidence before contacting us. Our specialist solicitors can explain what information may help support your claim.

How much compensation could be claimed?

The amount of compensation depends on the nature of the incident, the seriousness of the injury and the wider impact it had on your life.

Compensation may take account of:

  • Pain and suffering
  • Medical expenses
  • Lost earnings
  • Rehabilitation costs
  • Travel expenses
  • Damage to belongings
  • Other financial losses caused by the incident

Compensation is not awarded simply because the property or stay was disappointing. It is assessed according to the injury and any reasonable, provable losses resulting from it.

Every claim is assessed individually based on the available evidence and circumstances.

Why choose Holiday Claims Bureau for your Airbnb accident claim?

Airbnb accident claims can be significantly more complex than many hotel accident claims because responsibility is not always immediately clear.

Depending on the circumstances, it may be necessary to establish:

  • Who controlled the property
  • Whether the host, property owner or another party was responsible
  • Whether the accommodation was properly maintained
  • Whether cleaning standards were adequate
  • Whether the incident happened in the UK or abroad
  • Whether Host Liability Insurance, Experiences & Services Liability Insurance or another relevant policy may apply

Resolving these questions may require examination of the booking, property arrangements, platform records, applicable law and available insurance.

Our team can help investigate:

  • Airbnb accident claims
  • Accidents in privately owned holiday accommodation
  • Hot tub and swimming pool accidents
  • Unsafe balconies and stairways
  • Bed bug compensation claims
  • Airbnb Experience and Service accidents
  • Preserving booking and listing evidence
  • Identifying potentially responsible hosts, occupiers and service providers
  • Investigating potentially relevant insurance arrangements
  • No Win No Fee representation

Whether the incident happened in a city apartment, countryside cottage, overseas villa or during an Airbnb Experience, our specialist solicitors can investigate what went wrong and explain the available options.

Frequently Asked Questions

Airbnb accident claims can involve private homes, holiday properties, Airbnb Experiences, defective facilities, bed bug infestations and incidents in the UK or abroad. Below are answers to common questions raised by injured guests.
Can I claim compensation after an Airbnb accident?

Potentially, yes. If you suffered an injury because of unsafe accommodation, defective facilities, poor maintenance or another form of negligence during an Airbnb stay, our specialist solicitors can review what happened and explain whether the evidence may support a claim.

Does AirCover automatically compensate injured Airbnb guests?

No. AirCover for guests provides booking and stay support in circumstances such as host cancellations, check-in problems, materially different listings and certain safety concerns. Airbnb states that AirCover for guests is not an insurance policy and it does not automatically provide personal injury compensation.

Airbnb separately operates liability insurance programmes for eligible accommodation, Experience and Service hosts. Whether compensation is payable will still depend on legal responsibility, the evidence, the circumstances of the incident and the applicable insurance terms.

Can I claim if I was injured at an Airbnb abroad?

Potentially, yes. Claims involving overseas Airbnb accommodation can be more complex because different countries may have different legal systems, insurance arrangements, claim procedures and time limits. The correct defendant and legal route may also differ from those that would apply in the UK. Early investigation is important so that the relevant country, responsible parties and applicable deadlines can be identified.

Can I claim if I was injured by broken furniture or defective accommodation?

Potentially, yes. Claims may arise where broken beds, damaged furniture, unsafe stairways, loose flooring, faulty electrical appliances or other defects caused injury. Whether compensation can be pursued depends on the circumstances and who was responsible for maintaining the accommodation.

Can I still claim if Airbnb or the host offered me a refund?

Potentially, yes. A refund or goodwill payment may resolve a booking dispute, but it may not compensate you for an injury and the associated financial losses caused by the incident. Before accepting an offer described as a full and final settlement, it is sensible to obtain legal advice about whether it could affect a future claim.

What evidence do I need for an Airbnb accident claim?

Helpful evidence may include photographs, medical records, booking confirmations, screenshots of the Airbnb listing, messages exchanged through the Airbnb platform, witness details and evidence of financial losses. You do not need every piece of evidence before contacting us. Our specialist solicitors can explain what information may help support your claim.

Do you handle Airbnb accident claims on a No Win No Fee basis?

Yes. We handle eligible Airbnb accident claims under a No Win No Fee agreement. This means there is normally no upfront legal fee and no fee payable to us for our work if the claim is unsuccessful, subject to the terms and conditions of the agreement. Any potential deductions, insurance costs or other expenses will be explained before you decide whether to proceed.

Who is responsible if I was injured at an Airbnb?

Responsibility depends on the circumstances surrounding the incident. Depending on what happened, a claim may involve the Airbnb host, the property owner, a property manager, a cleaning or maintenance contractor, an Airbnb Experience provider or another party responsible for the property, facility or relevant service. Our specialist solicitors can investigate who may be legally responsible.

Can I claim after an accident during an Airbnb Experience or Service?

Potentially, yes. These claims are distinct from accidents inside Airbnb accommodation and may involve the Experience or Service host, another provider or relevant insurers. Report the incident to Airbnb after obtaining any urgent medical help, and keep the booking details and messages exchanged through the platform.

Can I claim if I was injured in an Airbnb hot tub or swimming pool?

Potentially, yes. Claims may arise where defective hot tubs, swimming pools, decking, steps, lighting or other leisure facilities caused injury because they were not properly maintained or made reasonably safe for guests.

Can I claim for bed bugs at an Airbnb?

Potentially, yes. If inadequate inspection, cleaning or treatment allowed bed bugs to remain in the accommodation and you suffered bites or related losses, you may be entitled to pursue compensation. Compensation may take into account physical symptoms, damaged belongings, reasonable cleaning or treatment costs and the wider impact of the infestation.

What should I do after an Airbnb accident?

Your health should always come first.

It may also help to:

  • Seek medical treatment if required
  • Report the incident to the host and Airbnb
  • Take photographs of the property, hazard and injuries
  • Keep booking confirmations and messages
  • Retain receipts for treatment or expenses
  • Collect witness details where possible

These steps may help support a future compensation claim.

How much compensation could I claim?

The amount of compensation depends on the seriousness of the injury and the impact it had on your life. Compensation may take into account pain and suffering, medical expenses, lost earnings, treatment costs, travel expenses, damaged belongings and other financial losses. Every claim is assessed individually based on the available evidence and circumstances.

Is there a time limit for making an Airbnb accident claim?

Time limits depend on where the accident occurred, who may be responsible and which law applies. UK and overseas claims may have different deadlines, so it is sensible to seek legal advice as early as possible.
